The legal bit

This website and its services are operated by SPM Fire Safety Consultancy Limited (I, Me, My, Mine)

The term “you/your” refers to the user, employer, client or viewer of our services and/or products.

I am registered in England and Wales under Company Number 10727884, with the registered address of:

Walden, Nollers Lane,

Spexhall,

Halesworth,

Suffolk. IP19 0RL

A fire risk assessment is a legal requirement but should not be seen as a demanding task but one to be embraced knowing that all reasonable steps have been taken to minimize the fire risk and ensure the continued safety of your staff and visitors.

In most cases an assessment can be completed in around two to three hours but in large or complex buildings this may take longer.

On the day, I will make myself known to the “responsible person”.

The Fire Risk Assessment conducted by me is a non-intrusive inspection only.

It will assume all relevant Building Regulations and any other permissions have been adhered to and it is based on the day of my visit only. Any alterations, extensions, reconfigurations, additions or removals or other such like changes to the assessed area, post visit, may invalidate the assessment.

See report for further details of when a new Fire Risk Assessment may be required.

I will review the documents, if available, asking questions pertaining to the assessment of the building.

I will then conduct a comprehensive inspection of all relevant areas of the building. During this time, I may ask more questions and seek further clarification, make notes and take any relevant photographs to support the written report.

Prior to leaving, if required, I can give a verbal debrief of their findings, but any areas of recommendation will be covered in the full written report. The verbal reasoning, while on site, are my initial thoughts only, and they may differ once further research and clarification is obtained post visit. This means that my verbal reasoning, or lack of, is to be discarded and the written electronic report will reflect the more accurate picture of the recommendations required to obtain compliance.

I will endeavour to notify you of completion of the report within 7 working days of my visit. This time period may vary depending upon external factors, such as, but not limited to, bank holidays, ill-health, workload etc. Any delay to the report being issued will be notified to you as soon as it is known and as quickly as practically possible.

I reserve the right to withhold the report and not release it until payment in full, including any cancellation fee or admin charges have been received.

Any outstanding monies or debts are to be paid within 10 working days of receipt of the invoice. Failure to do so will mean a £25 admin cost added to your total.

The title to any goods or services supplied does not transfer to you or any client or third party employing me until payment has been made in full.

The recommendations made in any report are the obligation of the responsible person or their representative to undertake and fulfil. Failure to complete them is not mine or my representatives responsibility, and I accept no liability as a consequence, either with costs, time or other detrimental effect for failure to complete any recommendation or action arising from the report.

I will hold data, for the purpose of using my services only. It will not be shared or sold to any third party. All data will be securely disposed of 6 months after any contact or contract with me is completed. You may request disposal of data held, at any time by informing me in writing or e-mail. I am registered with the Information Commissioners Office.

All recommendations within the report are based on best practice, guidance, British Standards, the primary legislation of the Regulatory Reform(Fire Safety) Order 2005 and fire service experience and I have no connection with any suppliers of fire safety equipment or products, except for fire training of any staff by me.

There may be different interpretations given by the local fire authority or other enforcing agency to the best practice, guidance, British Standards, the primary legislation of the Regulatory Reform(Fire Safety) Order 2005 and fire service experience, and I cannot be held responsible for these interpretations and any additional sanctions or costs arising from them.

Post report issue - I am available, by email or telephone only, after the report has been issued to answer questions or clarify any recommendations that may need further explanation.

Should a revisit to site be required, for any reason, then this may attract additional costs.

Any additional costs will be notified to you prior to my revisit, and will require payment in full before the agreed date. .

Please Note – I cannot and will not carry out a Fire Risk Assessment on an uncompleted building or a building still under construction or alteration. A risk assessment done on such a premise would be based on the day it was seen and further works or alterations carried out after my visit would make it invalid and may require a new assessment, thus incurring extra cost.

I therefore suggest waiting until the building is completed before requesting your fire risk assessment.

If in doubt please contact me prior to the visit as there is a cancellation fee if the Risk Assessment cannot be completed due to unfinished works.

Any PowerPoint presentations will remain the property of mine but may be used by you for training purposes within your building/company only and are not transferable to other outside or external persons or entities.
If practical fire extinguisher training is to be completed, then a suitable area will be required to complete this. It is your responsibility to select this area, and I cannot be held responsible for any damage caused because of the discharge of the fire extinguishers, by an inappropriately chosen site.

Extinguishers used will be water and Co2 only.

Any cancellation to my visit should be made prior to 24 hours before our visit or a £25 admin cost may apply.
